Terms of Service

Welcome to Casso! These Terms of Service ("Terms") govern your use of the Casso mobile application ("App") operated by Casso ("we", "our", or "us").

By using Casso, you agree to these Terms. If you do not agree, please do not use the App.

1. Description of Service

Casso is a mobile application that allows users to:

Upload photos of their pets
Generate AI-created artwork using those photos
Share generated images and send them to digital picture frames

2. Account Registration

You must provide accurate information when creating an account
You are responsible for maintaining the security of your account
You must be at least 13 years old to use Casso
You may not create or maintain multiple accounts

3. User Content

Your Content

You retain ownership of photos you upload
By uploading content, you grant us a license to process it for AI generation
You represent that you have the right to upload any content you submit

Generated Content

AI-generated images are created for your personal use
You may share generated images on social media and in personal contexts
Generated images may not be used for commercial purposes without our prior written consent

Prohibited Content

You may not upload content that:

Violates any laws
Infringes on others' intellectual property
Contains inappropriate or offensive material
Depicts humans (Casso is designed for pet photos only)

Content that violates these restrictions will be rejected by our automated content moderation system. Repeated violations may result in account suspension.

4. Credits and Purchases

Credits are required to generate AI images
Credits are purchased through in-app purchases via Apple App Store or Google Play
Credits are non-refundable except as required by law
Refunds for purchases made through the Apple App Store are handled by Apple in accordance with their refund policy
Refunds for purchases made through Google Play are handled by Google in accordance with their refund policy
Unused credits do not expire

5. AI-Generated Content and Third-Party AI

Images are generated using Google Gemini AI, a third-party artificial intelligence service operated by Google
By using the image generation feature, you consent to your pet photos being transmitted to Google Gemini AI for processing
Your photos are sent securely via HTTPS. Please refer to Google's privacy policy for details on how they handle data
All generated content passes through automated content moderation to ensure safety and appropriateness
Results may vary and are not guaranteed
AI-generated content is for entertainment purposes
We do not guarantee the accuracy, quality, or suitability of generated images

6. Acceptable Use

You agree not to:

Attempt to reverse engineer the App
Use the App for any illegal purpose
Interfere with the App's operation
Create multiple accounts to abuse free credits
Share your account credentials

7. Intellectual Property

The Casso app, branding, and technology are our property
Prompt templates and UI designs are protected
You may not copy or reproduce the App

8. Termination

You may delete your account at any time via Profile > Danger Zone
We may suspend or terminate accounts that violate these Terms
Upon termination, your data will be deleted in accordance with our Privacy Policy

9. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

Uninterrupted service
Error-free operation
Specific results from AI generation

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Casso and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Dispute Resolution

Before filing any legal claim, you agree to contact us at support@cassoapp.com and attempt to resolve the dispute informally for at least 30 days.

13. Changes to Terms

We may update these Terms periodically. We will notify you of significant changes via the app or email. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Disputes that cannot be resolved informally shall be resolved in the state or federal courts located in Texas.

15. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

These Terms are between you and Casso, not Apple. Apple is not responsible for the App or its content.
Apple's Standard Licensed Application End User License Agreement (EULA) applies to your use of the App. In the event of a conflict between these Terms and Apple's EULA, Apple's EULA shall take precedence for App Store purchases.
Apple has no obligation to provide maintenance or support for the App.
Apple is not responsible for any claims relating to the App, including product liability, legal compliance, or intellectual property claims.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Google Play Terms

If you downloaded the App from Google Play, the following additional terms apply:

These Terms are between you and Casso, not Google. Google is not responsible for the App or its content.
Google has no obligation to provide maintenance or support for the App.
Google is not responsible for any claims relating to the App, including product liability, legal compliance, or intellectual property claims.
